Cancellation Policy TYBA Health Emergency – Cancellation - Postponement Advisory Relating to Coronavirus Disease (COVID-19) as of March 14, 2020 1. The signing parties responsibilities arising from the relevant yacht charter agreement shall be suspended in case of; destination country, i.e. Turkey or embarkation/disembarkation port/s are declared as no-go by the Government of Turkey or Charterer’s departing country within 4 weeks prior to commencement of the charter date due to Coronavirus Disease (COVID-19). Any direct consequences, such as; quarantine, travel ban, entry/exit restrictions from local and/or national authorities, or International Turkish airports being placed in quarantine or closed to flights originating from the country of charterer where they depart or charterer’s country or the area of residence being in quarantine disabling transport of Charterer or the vessel with its crew in quarantine may result in a situation such that the Owner and / or the Charterer will not be able to honour the charter agreement. 2. The warnings and travel restrictions must be made by the ‘’Government” shall mean the competent authorities, supreme bodies, at Ministry level of the flag state of the Vessel, Charterer’s country of residence, countries of embarkation and disembarkation and country/countries in which the Vessel is navigating during the Charter Period, order to be considered as valid restriction of travel reason. 3. In such case the parties hereby agree that the part of the funds exceeding 50% of the agreed charter party fees including VAT paid to date by the Charterer to the Broker(s) and/or the Owner will be refunded less any bank expenses and the charter agreement will be suspended and postponed until the health emergency situation as described above or other reasons shall be lifted or in any case for a maximum period of 18 months after the first date of initial Charter period and before the 1st of November 2021. For the remaining 50% of the Charter fee or any amounts lower then %50 of the charter fee paid to date by the Charterer, a Credit Note will be issued by the Broker and Owner to the Charterer to be used for a new charter within the time frame described above in the same destination, vessel and charter length subject to the vessel’s availability. The booking shall be made latest by 31st of January 2021, and any difference in the new charter fee shall be paid by the Charterer. 4. In case of cancellation or postponement of the yacht charter agreement, in whole or in part, in relation to the Covid-19 Disease as described above, either the Broker(s) will retain any commission already paid which shall be deemed fully earned; or the Broker(s) will retain the percentage of the commission corresponding to the pro rata payment of the Charterer. 5. If there will be any date change due to th COVID -19 virus ; The rental prices of the periods has to be same .If any price difference due to the rental periods according to high – low season the clients must be paid the cost difference. lf the reservation dates changed to 2021 season, the reservation will be valid for the same boat. Any cumpolsory reason occures ( Sales of the of the Boat, etc ) to change the boat, Our compnay will provide a same quality and capacity boat to the clients . Any Price differece occures because of refits/renovation to the boat that rent by the clients, the 2021 Price difference has to be paid by clients. Further precautions will be pursued for all charters:  Owner will ensure that the crews have not visited any "affected areas", as determined by the World Health Organization (WHO) within 4 weeks of the charter commencement date.  Crew hygiene will be supervised for all charters and governmental health regulation polices will be applied.  Sanitary measures such as routine cleaning and proper disinfection practises including biological treatment/cleaning will be taken on board before each charter starts if the ports of embarkation have had any past record of virus infection case/s.
